These terms and conditions apply to any purchases by you of goods or services from Lovisa Pty Limited ABN 62 120 675 890 (Lovisa, we, us, our), including purchases made using the Lovisa online store and purchases made at any physical Lovisa store.

If you wish to purchase goods or services from Lovisa, you must read these terms and conditions, together with each of the following policies, prior to proceeding with any such purchase:

These terms and conditions apply to the exclusion of any terms on any order form or other document issued by you. We may update or amend these terms and conditions from time to time.

By making a purchase, you are accepting and agreeing to the following terms and conditions as at the time of your purchase. Please read carefully.

Shipping & Delivery 

Lovisa provides shipping and delivery to all residential addresses in Australia and New Zealand. The following terms and conditions apply to shipping and delivery of Lovisa products purchased through the online store.  For more information, please refer to the Lovisa Shipping and Delivery terms, available here.

Title and Risk

In-store purchases

Title and risk to any goods purchased by you from Lovisa will remain with Lovisa and will only pass to you on payment in full for those goods.

Online purchases

As between you and Lovisa, title and risk to any goods purchased by you from Lovisa will remain with Lovisa and will only pass to you on occurrence of both payment in full for those goods and successful delivery of those goods to the address nominated in your online order.

Placing Online Orders

Orders for goods and services are placed by you when you proceed through our online store, input your order details and payment information and confirm payment of the order. On successfully placing and making payment for an online order, we will send you an order confirmation to the email address you provided during the purchase process.

You are responsible for checking and confirming your order, including your order details, products, information and delivery address, are correct at the time of placing an online order. To the extent permitted by law, Lovisa accepts no liability or responsibility for any incorrect orders or order details.

Once an online order is placed, Lovisa is not generally able to make any amendments to product, customer, or delivery details. If the order has not been dispatched from our warehouse, we may be able to cancel the order and make changes to delivery information, however we cannot guarantee this.

Click & Collect Orders

At the time of entering your delivery preferences as part of the online order process, you may select the Click & Collect option, in which case you will be directed to select a Lovisa store for pick-up.

On your confirmation of the online order and payment, your goods will be dispatched from our warehouse and will be shipped to your selected store for pick up. You will be notified via the email address you provided at the time of confirmation when your order is ready for collection.

From the date the email confirmation stating your order is ready for collection is sent to you, you will have 14 days to collect your order from the nominated Lovisa store.  If you fail to collect your order within this time, we will send you a final reminder, requesting that you collect your order within 72 hours. If you fail to collect your order within 72 hours of this reminder, we will cancel your order and you will be provided with a full refund of all amounts paid for your order.

In order to collect your order from your nominated Lovisa store, you must attend the store in person with a valid form of photo identification (which must match the details against the Click & Collect Order), and provide to the store your order number or a copy of your email confirmation stating your order is ready for collection. Lovisa reserves the right to deny any attempts to collect orders which do not comply with these requirements.

If you wish to nominate another person to collect your order on your behalf, please contact our Customer Support team.

Problems with Online Orders

Lovisa reserves the right to cancel any order placed on the online store where there are errors, inaccuracies or out-of-date information regarding pricing, stock availability, product descriptions or other matters related to the online orders. 

If your online order is cancelled for these reasons, we will contact you to make other arrangements (such as provision of substitute products). If you wish, you are entitled to a full and prompt refund for all amounts paid for any such cancelled online orders.

Lovisa further reserves the right to cancel any online orders where Lovisa reasonably believes or suspects that the order was placed fraudulently or maliciously.

Price

Prices for goods and services are as marked (both in-store and on the website), provided however that Lovisa reserves the right to amend any prices at any time prior to purchase where Lovisa believes there has been an error, mistake or the incorrect price was inadvertently given in relation to the good or service.

You are responsible for meeting all taxes, duties, charges and otherwise (including any customs and import taxes) associated with your purchase of goods and services from Lovisa. If additional taxes or duties are payable on your purchase based on your region, these will be charged to you as part of the checkout process.

Unless otherwise stated in-store or on our online store, all prices are stated inclusive of GST and all other applicable taxes, and will be stated in either of Australian Dollars or New Zealand Dollars (as applicable). Lovisa is not responsible for any currency conversation rates charged as a result of you making your purchase with another currency.

Unauthorised purchases

Lovisa makes the goods and services available for sale, both in-store and online, for personal use only and not for any wholesale purposes. You must not offer for resale any goods or services purchased from Lovisa without Lovisa’s express prior written consent.

Sales, Promotions & Online Exclusive Offers

Limited Time Offers

Limited Time Offers apply to selected styles only.

All limited Time Offers are valid for a specific period only. This information can be found on the promotion’s page. Lovisa may change the period for Limited Time Offers from time to time.

All Limited Time offers may only be available online. This information can be found on the promotion’s page.  

Online Exclusives and Online Exclusive Promotions

Online Exclusives and Online Exclusive Promotions are available online only and are not available in-stores. Sales and prices associated with Online Exclusives and Online Exclusive Promotions will not be applicable to in-store purchases.

Payment Options

We have set out below the payment methods which we accept for payments in our stores and online. We may change these payment methods from time to time.

You are responsible for ensuring that you comply with the terms and conditions, including transaction limits or purchase requirements, and in particular in relation to any buy-now-pay-later service providers, for any payment method you utilise to make a purchase from Lovisa.

Payment Options

Cash, EFTPOS and credit cards are accepted as valid payment methods in any of our Lovisa stores. In addition, our online store accepts the following forms of payment: Shop Pay and PayPal.

Buy-now-pay-later

Lovisa also accepts (in certain regions only, both online and in-store) buy-now-pay-later payment methods offered through Klarna, Afterpay, Clear Pay and Atome Pay Later. 

Collections

The Sensitive Ear Collection 

Lovisa is confident your skin will love pieces from the Sensitive Ears Collection. However, should your skin have a reaction from any of the items featured, we offer an 100% money-back guarantee so you can shop with certainty. Please note that if you wish to return, ensure you keep a hold of your receipt/order confirmation and the packaging your earrings came in. 

Gift Cards

Physical Gift Cards

Physical Gift Cards can only be purchased in-store. In-store purchased gift cards can be redeemed in-store or online, only in the country of purchase.

Lovisa Gift Cards are to be treated like cash and are redeemable with Lovisa only. Damaged, lost or stolen cards will not be replaced, refunded or redeemed. It is not redeemable for cash, credit or retailer accounts. Lovisa Gift Cards must be redeemed before the expiry date. The gift card cannot be reloaded beyond the initial value placed on the card. Gift cards with an unused balance on expiry will not be refunded or credited.

e-Gift Cards (Australia & New Zealand Only)

You may purchase an e-Gift Card from anywhere in the world, provided the recipient has an Australian or New Zealand residential address.

Once purchased, Lovisa e-Gift Cards are emailed to your nominated email address and can be redeemed online or at any of our Australian store locations. Unfortunately, e-Gift Cards cannot be redeemed in New Zealand stores, however they can be used for online purchases with shipping to New Zealand.

Piercing e-Gift Cards

Piercing e-Gift cards can be redeemed in store within Australia only. 

Once purchased, they are emailed to your nominated email address that will contain a card number, a 4 digit pin to use in store as well as your card's expiry date and value. 

Please note:

You are liable for all transactions on your gift card and Lovisa accepts no liability or responsibility in respect of any unauthorised transactions made using a valid gift card, except when there has been fraud or negligence by us or our employees.

Contact our Customer Support team if you have any reason to believe an error has occurred in relation to a gift card.

Australian Consumer Law

Lovisa’s goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

For any and all other claims against Lovisa (whether for breach of contract, negligence or on any other basis):

  • Lovisa’s total aggregate liability will be limited to the total amount actually paid by you for the goods or services that are the subject of the claims; and
  • Lovisa will not be liable to you for any loss that does not arise naturally, that is, according to the usual course of things from the relevant breach, act or omission, even if such loss was known or ought reasonably to have been known to Lovisa.

Apart from the guarantees provided under the Australian Consumer Law, the only conditions, guarantees and warranties which are binding on Lovisa in respect of the state, quality or condition of the goods and the services are those imposed by statute which cannot be excluded.
